Terms of Service (ToS)

Article 1: Object

These ToS define the terms of availability of the services of the mia-cv.com website (hereinafter "the Service") and the conditions of use of the Service by the User.

Article 2: Description of Services

The Service offered by HumanX is a SaaS (Software as a Service) solution for CV optimization and AI-assisted cover letter generation.

The Service allows Users to:

  • Benefit from an automated audit of their CV.
  • Optimize the content of their CV for specific job offers.
  • Generate cover letters.

Article 3: Access and Registration

Access to certain services requires the creation of a user account ("Member Area"). The User agrees to provide sincere and accurate information.

Access to the Service can be:

Free: Limited access to basic features (simple audit without generation).

Paid: Via subscription or credits, allowing access to advanced features (generation, PDF download, etc.).

Article 4: Intellectual Property

All elements of the Site (code, design, text, logos) are the exclusive property of HumanX. However, the User retains full ownership of the data they transmit (original CV, personal information) and the final documents generated by the Service for their personal use.

Article 5: User Responsibility

The User is solely responsible for:

  • The confidentiality of their login credentials.
  • The content of the CVs and documents submitted to the Service. They agree not to transmit illegal, discriminatory content or content infringing on third-party rights.
  • The User acknowledges that AI may make mistakes (hallucinations). It is their responsibility to proofread and validate the generated documents before any professional use.

Article 6: Payments and Credits

Payments are secured and managed exclusively by our provider Stripe. Subscription to paid offers is firm and final for the committed period, unless otherwise provided by the legal right of withdrawal (14 days) if the Service has not been fully executed (i.e., if no document has been generated/downloaded).

Article 7: Personal Data

The processing of personal data is governed by our Privacy Policy, in accordance with the GDPR.

Article 7-bis: Artificial Intelligence (AI) Processing and International Transfers

In accordance with GDPR and the European AI Act

The User is expressly informed and consents that:

🤖 AI Technologies Used

The Service uses artificial intelligence systems provided by third parties, including OpenAI (GPT-4) and Google (Gemini), for CV analysis, optimization, and cover letter generation.

🌍 International Transfers

CV data is transmitted and processed in the United States, where the servers of these AI providers are hosted. These transfers are governed by the European Commission's Standard Contractual Clauses (SCC) and data protection guarantees equivalent to GDPR.

🎯 AI Processing Purposes

  • Semantic analysis of CV and job offers
  • Detection of skills, experiences, and ATS (Applicant Tracking System) keywords
  • Generation of optimized CVs and personalized cover letters
  • Calculation of compatibility score with job offers

🗄️ Data Retention

Data transmitted to AI models is not used to train these models (in accordance with agreements with OpenAI and Google). Data is temporarily stored during processing then deleted.

✋ Right to Withdraw Consent

The User may withdraw their consent to AI processing at any time by contacting us at support@mia-cv.com. Withdrawal of consent results in suspension of services requiring AI processing.

⚠️ AI Act Transparency

The User is informed that results generated by AI may contain errors or inaccuracies (hallucinations). It is the User's responsibility to verify and validate any information before professional use.

Article 8: Applicable Law

These ToS are subject to French law. In the event of a dispute not resolved amicably, jurisdiction is granted to the courts within the jurisdiction of the Court of Appeal of Paris (or Bobigny).
